First distribution of seats
The procedure of the first distribution of seats, which begins immediately after the results have been collected and ranked, is carried out by the Chief Returning Officer. For this purpose, the sum of the total number of valid votes, divided by the total number of seats, shall be calculated. The resulting quotient, omitting the fraction, constitutes the electoral threshold by which the electoral power of each list or independent candidate shall be divided. Each list is entitled to as many seats as the times the electoral threshold is included in its electoral power.

Example:
Let us assume that we have a total of 300,000 valid votes and that list A receives 105,000 votes. In order to find the electoral threshold, the following mathematical operation is performed. We divide the total number of valid votes (300,000) by the total number of seats (6): 300,000: 6 = 50,000 (electoral threshold for the purpose of the first allocation of seats).

The total number of valid votes cast for list A shall be divided by the figure of 50,000 which is the electoral threshold in order to find the number of seats this list shall be entitled to. In this case we carry out the following mathematical operation: 105,000: 50,000 = 2 seats, which are allocated to the list and a remaining 5,000 votes, as unused balance, which will be carried forward to the second distribution of seats in favour of the same list.

In the same way is divided the total number of valid votes cast of every other list and every individual candidate who participates in the elections. If the total number of valid votes of a list is below the electoral threshold, in other words below 50,000 votes, i.e. the electoral threshold, the list shall not obtain any seat from the first distribution of seats.

Allocation of seats: The 2 seats to which list A is entitled from the first allocation, shall be allocated to the 2 list candidates who have received most preference crosses, irrespective of the series in which their names appear on the ballot paper.

In the event of a tie between two or more candidates in the list, if the seats allocated to the list in question are less than the number of candidates who are tied, the allocation of the seat shall be decided by drawing lots carried out by the Chief Returning Officer in the presence of the candidates and the candidate whose name has been drawn shall be declared as a Member of the European Parliament.

Second distribution of seats
The seats that remain unallocated after the first distribution of seats, shall be carried forward and distributed on the basis of the second seat distribution procedure amongst the independent parties, party coalitions, lists of independent candidates or independent candidates who have obtained 1.8 per cent (1.8%) of the total number of valid votes, irrespective of whether they have been successful in receiving any seat in the first distribution, in accordance with the amount of their remaining unused votes.

A seat allocated in accordance with the above to an independent party, a party coalition or list of independent parties, shall be taken by their candidate who has the highest number of preference crosses .
